Public Tender Overview:

This Contract Award Notice is acting as a Modification Notice under Article 72 of 2014/24/EU to CFT 3109037 Contract for Darndale Park Waste Removal and Wall Construction to Breffni Building and Civil Engineering. Description of the procurement at the time of conclusion of the contract: The Contract comprises clearance and removal of approximately 40,000 tonnes of illegally dumped waste material and construction of boundary treatments and 117m of new 2.5m high precast boundary wall and footpath between Darndale Park and a group of Traveller Accommodation site known as the Northern Sites on the north side of Dublin within the boundaries of Darndale and Priorswood. The works shall include site clearance, removal of all waste material (investigations suggest non-hazardous), removal of asbestos, removal of end-of-life vehicles and other electrical goods, treatment and removal of invasive species, construction of concrete boundary walls, construction of new footpath, environmental monitoring. There is a requirement for removal of hazardous waste should it be encountered. Temporary works shall include construction of a construction stage haul road through Darndale Park to provide site access and all associated reinstatement works, protection to all existing services, fencing of works areas etc. Design of temporary works shall form part of the works. Changes arose in the following areas which were instructed in accordance with the provisions of the Public Works Contract - Removal and disposal of additional waste - Removal and disposal of horse carcass, contaminated waste, oil - Removal and disposal of large amount of historic concealed waste - Filling of excavated area with Article 27 backfill - Continued delays due to local obstruction of drainage construction - Construction of a new watermain that burst during excavation for drainage - Extensions of time under contract

There were two modifications carried out, as justified under Article 72.1 (c). The total value of these modifications was €4,710,950. Dublin City Council confirm that no one modification exceeded 50% value of the original contract. Reasons for modifications: Difficulties in obtaining site investigation information and surveys prior to contract limited the level of information in tender documents. Quantity of waste above ground was larger than could be estimated and additional waste that was previously concealed was discovered upon excavation for a foundation after removal of main waste mound. Limited site investigation of large mound did not discover horse carcass, asbestos or buried oil waste. Additional category B2 waste also arose from the main drainage excavation and a burst watermain that was impeding work on the drain had to be replaced. Position of these services was inaccurately shown on Utility maps.
